International Arbitration

Skills - 3 units. This seminar will provide students with an introduction to the theory and practice of international arbitration and familiarize them with the framework of international treaties and national laws that undergird the international arbitral system. We will analyze the elements of an international arbitration clause, and examine the relevance of the stipulated arbitration rules, the agreed-upon place of arbitration, and contractual options concerning arbitrator selection. Students will also gain a practical, in-depth understanding of each of the principal stages of the arbitral process, including: enforcement of the arbitration agreement; initiation of proceedings; pursuit of provisional remedies; and conduct of the arbitration itself – from the pleading stage, through the exchange of written submissions, to the handling of the merits hearing. We will conclude by examining procedures for enforcing and challenging the arbitral award. Sessions dedicated to legal theory will be complemented by classes devoted to practical simulations and skills development, with special focus on oral advocacy and cross-examination.
